Online Access Agreement

 

General Terms and Conditions

You agree that any information or disclosures or notices supplemental to or under this Agreement or by law or regulation or any amendments to this Agreement may be sent to you by electronic communication, including by e-mail to you or by posting on NAFT Federal Credit Union's website at www.naftfcu.coop. By using the Bank365 service you agree to abide by the terms and conditions of this Online Access Agreement.  Bank365 is governed by applicable Federal laws and regulations and in accordance with the applicable laws and regulations of the State of Texas.  Bank365 is used to access information and to perform transactions on accounts held at NAFT Federal Credit Union.  These accounts are governed by the Membership and Account Agreement that was provided to you when the account(s) were opened. The terms "we", "us", "our" and "credit union" refer to NAFT Federal Credit Union. The terms "you" and "your(s)" refer to each owner of an account. The term "business day" means every day except Saturdays, Sundays and Federal Holidays.

    In addition to this Online Access and Electronic Funds Transfer Agreement you agree to be bound by and will comply with the requirements of the applicable Membership and Account Agreement, the Credit Union's rules and regulations, the rules and regulations of any funds transfer system to which the Credit Union belongs, and applicable state and federal laws and regulations.

This Online Access Agreement for accessing your accounts via NAFT Federal Credit Union's Bank365 explains the terms and conditions governing all Credit Union services offered through NAFT Federal Credit Union's Online Services (Bank365).  Only accounts that are maintained with NAFT Federal Credit Union may be accessed through NAFT Federal Credit Union's online banking system "Bank365".

 

The first time you access any of your accounts through Bank365 confirms your understanding and agreement to this Online Access and Electronic Funds Transfer Agreement and acknowledges your receipt of this disclosure.

Bank365 Password

When you initially sign up for Bank365 by coming to one of the credit union offices you will be given a password that will enable you to access your account information through the Bank365 service. We recommend that you change your password regularly.  It is recommended that you memorize your Bank365 password and do not write it down or give it to anyone.  You are responsible for safeguarding your password and other account data.  We are entitled to act on instructions received under your password.  You agree that NAFT Federal Credit Union may send notices and other communications to the address shown in our records and that NAFT Federal Credit Union is not liable to you in any way if this information is accessed by an unauthorized person.  You agree to keep your account information and password secure and strictly confidential.  You agree to immediately notify us if you believe your password or account number has been obtained by an unauthorized person and you agree to change your password immediately.  NAFT Federal Credit Union reserves the right to cancel any person's access to Bank365 if it believes the security of a person's account information and access has been breeched. You may cancel your access to Bank365 online services by contacting our member service department at 956-787-2774.

If you give someone your account number and password, you are authorizing that person to use the service and you are responsible for all transactions that person performs using the service. All transactions that person performs, even those transactions you did not intend or want performed, are authorized transactions. You agree to assume responsibility for all transactions through the service with your NAFT Federal Credit Union Account Number and Password, up to the limits allowed by applicable law. Transactions that you or someone acting with you initiates with fraudulent intent are also authorized transactions.

 

NAFT FEDERAL CREDIT UNION WILL HAVE NO LIABILITY TO YOU FOR ANY UNAUTHORIZED PAYMENT OR TRANSFER MADE USING YOUR ACCESS ID (ACCOUNT NUMBER) AND PASSWORD THAT OCCURS BEFORE YOU HAVE NOTIFIED US OF POSSIBLE UNAUTHORIZED USE AND WE HAVE HAD A REASONABLE OPPORTUNITY TO ACT ON THAT NOTICE.

Liability

Except as specifically provided in this Online Access Agreement or where the law requires different standards, you agree that neither we nor the service providers shall be responsible for any loss, property damage or bodily injury, whether caused by the equipment, software, the credit union, or by Internet browser providers such as Netscape (Netscape Navigator browser) and Microsoft (Microsoft Explorer browser), or by Internet access providers or by online service providers or by an agent or subcontractor of any of the foregoing, nor shall we or the service providers be responsible for any direct, indirect, special or consequential, economic or other damages arising in any way out of the installation, use or maintenance of the equipment, software, the Online Services, or Internet browser or access software.

Transaction Limitations

The number of transfers from a savings account is limited as described in the applicable Membership and Account Agreement that was given to you at the time you opened your account.  If a hold has been placed on a deposit made to any account that you are permitted to transfer from, the funds will not be available to transfer until the hold expires.

Termination of Services

     

    NAFT Federal Credit Union reserves the right to terminate this Online Access Agreement and your access to Online Services through Bank365, in whole or in part, at any time.

Change to Terms, Fees or Charges

NAFT Federal Credit Union reserves the right to change charges, fees and other terms in this Online Access Agreement.  You will be provided with advice of the change at least thirty (30) days prior to the effective date of the change unless an immediate change is necessary to maintain the security of the system. You may accept or decline the change by continuing or discontinuing the applicable service.

 Disclosure of Account Information

You authorize NAFT Federal Credit Union to disclose to third parties information you have provided or that we or our affiliates have obtained about your accounts and the transfers you make:

  • To comply with government agency or court orders or request; or

  • To verify the existence and condition of your account for a third party, such as a credit bureau or merchant; or

  • Where it is necessary for completing transfers; or

  • To provide services relating to your account or to offer other products and services;

  • If you give us your permission; or

  • In accordance with the Credit Union's Privacy Policy which is attached to this Agreement.

Negligence

 

NAFT Federal Credit Union will not be responsible for member errors or negligent use of the Bank365 service and will not be responsible for losses due to the following:

 

  • Input errors or misuse of the Bank365 service.

  • Negligent handling or sharing of passwords leading to unauthorized access to your accounts.

  • Failure to safeguard your computer during an online home banking session

  • Failure to report known instances of unauthorized account access within 2 business days.

Protecting your Account

Your role is very important in the prevention of any wrongful use of your account. You must promptly examine your statement upon receipt. If you find that your records and ours disagree, you must immediately call our Member Service Department at 956-787-2774.  In addition to protecting your account information, you should take precautions to protect your personal identification information, such as your Social Security Number, driver's license number, etc. The disclosure of the information by itself or together with information regarding your account may allow unauthorized access to your account(s). It is your sole responsibility to protect personal information with the same level of care that you protect your account information.

 

Information about Bank365

Account Access

In order to access your accounts online through Bank365 you must be a member in good standing of NAFT Federal Credit Union.  In addition, you must sign up for Bank365 at any of the Credit Union's offices.  At the time you sign up for Bank365 you will be assigned an initial password that is used to access this service.  The Bank365 link is located on the credit union's home page at www.naftfcu.coop.

Password

The password used to access the Bank365 system is case sensitive allowing upper and lower case letters to be used.  It is also alpha numeric allowing both letters and numbers to be used.  The password must contain at least 7 characters and will accept a maximum of 15. It is also required for you to use at least one number and one letter. For added security, it is highly recommended that you safeguard your password, change it regularly.  To change your password click on the services button on the Bank365's main menu screen.

Account Types

The following account types can be accessed through Bank365 for informational purposes:

  • Share Savings trailer (00)

  • Share Draft (Checking) trailers (91) (92) (93),

  • Special Savings trailer (61)

  • Christmas Club Account (63)

  • IRA Club Accounts (64 - 69)

  • Term Share Certificates (71-79)

  • IRA Term Share Certificates (81-89)

  • Loan Trailers (21-39)

 

Monetary transactions are limited to transfers between trailers within the same account.

The type of transfers that are allowed are as follows:

 

  • Share Savings trailer (00) to trailers (61, 62, 63, 91, 92, 93, 21-39)

  • Special Savings trailer (61) to trailers (00, 62, 63, 91, 92, 93, 21-29)

  • Share Draft (Checking) trailers 91, 92, 93 to trailers (00, 61, 62, 63, 21-29)

  • Personal Savings trailer (62) to trailers 00, 61, 63, 91, 92, 93, 21-39)

 Fees

Currently there are no monthly service fees associated with accessing your accounts through Bank365. However,  for regular share and Special Savings accounts, a fee of $1.50 will be assessed for each withdrawal or transfer in excess of three (3) withdrawals or transfers per month.  For transfers from personal savings account (62), a fee of $5.00 will be assessed for each withdrawal or transfer in excess of two (2) per month.

For other services accessed through Bank365 the following fees apply:

            

            Loan Application Fee for Signature Loans                      $20.00

            Loan Application Fee for Secured Loans                         $10.00  

            Draft Order Fee                                                           $  3.00

Electronic Mail (e-mail)

Through Bank365 you are able to communicate with the credit union via e-mail to apply for services such as loans, new accounts and Bank365.  However, in most cases you will be required to come into one of our offices to complete the process to sign the appropriate documents and receive the necessary disclosures.  For other purposes you may contact the credit union via our regular e-mail address at naft@naftfcu.coop or you may contact the credit union by telephone at 956-787-2774.

New Bank365 Services

NAFT Federal Credit Union may in the future offer new online services through Bank365.  We will update the Online Access Agreement to inform you of these services.  By utilizing the new services you agree to be bound by the terms contained in this agreement.

 

 Minimum System (hardware) Requirements

  • Printer or PC for screen prints

  • Windows 95, Windows NT 4.0 or higher

  • Netscape 3 or above or Internet Explorer 3.02 or

  • Standard TCP/IP Internet Service Connection

  • Any version of Intuit Quicken, or Microsoft Money for downloads

  • Web Browser that utilizes a 128-bit encryption, Bank365 supports all

            browsers of Microsoft Internet  Explorer 4.01 or Netscape Communicator

            4.5 or higher

Bank365 Hours of Operation

 

Bank365 is available seven days a week, 24 hours a day.  At times the system may be unavailable due to system maintenance.  At these times you may use C-U by Phone or come into one of our offices.

ATM CARD, VISA CHECK CARD AND ELECTRONIC FUND TRANSFERS AGREEMENT AND DISCLOSURES

AGREEMENT

 1.  Issuance of Card or Personal Identification Number.  In this Agreement and Disclosures ("Agreement"), the words "you," "your," and "party" refer to any person to whom a NAFT Federal Credit Union ATM Card or VISA Check Card (collectively, "Card") is issued, any person to whom a Personal Identification Number ("PIN") is issued in connection with any such Card or other electronic fund transfer service, any person authorized to use or given access to use to any such Card or PIN, and any owner on any Credit Union Account which may be accessed by the Card or the PIN. The words "we," "us," "our," and "Credit Union" refer to NAFT Federal Credit Union. You agree that any use of a Card or PIN by you shall be governed by the terms and conditions set forth in this Agreement, as well as the terms of your Account Agreement with us, which is incorporated into this Agreement by reference.

 2.   Overdrafts. You agree that you will not use your Card and PIN to withdraw or transfer funds from your Account in amounts exceeding the available balance in your Account at the time of any such transfer. You agree that we will be under no obligation to make a withdrawal or transfer if there are insufficient funds in your Account. If your Account has sufficient funds to cover one or more but not all checks, withdrawal orders, or electronic fund transfers during any given business day, we may honor those items, allow those withdrawals, or make any such electronic fund transfers in any order that we choose in our sole discretion including first honoring any such checks, orders, or transfers payable to us, and dishonoring or refusing any item, order, or transfer for which there are insufficient funds available thereafter.

 3.   Card Security. You agree to keep your Card and PIN in a place of safekeeping, to refrain from disclosing your PIN to any third party, to refrain from writing your PIN on your Card, and to refrain from recording or displaying your PIN in such a manner that it will be accessible by third parties. You agree that the use of the Card or PIN by (i) you, (ii) any other applicant, (iii) any party to any of your Accounts that may be accessed by the Card, (iv) anyone you permit or authorize to use your Card or PIN, and (v) anyone to whom you disclose your PIN or give access to your Card or PIN shall be deemed an authorized use for which you shall be liable. You are responsible for reporting the loss or theft of your Card or PIN to us as soon as possible after the loss or theft.

 4.   Surrender, Cancellation, and Amendment. You agree to surrender your Card to us upon demand. You agree, further, that the Card shall at all times remain our property and that we may terminate any one or more electronic fund transfer services or cancel this Agreement at any time, subject to such notification as may be required by applicable law. You also agree that we may amend, supplement, or add to this Agreement and Disclosures from time to time, subject to such notification as may be required by applicable law.

 DISCLOSURES

 1.   Transfer Types. The following electronic fund transfer services are available:

 ATM Card

Account Access - You may use your NAFT Federal Credit Union ATM Card and PIN to:

  • Withdraw cash from your Checking Account

  • Withdraw cash from your Savings Account

  • Transfer funds between your Checking and Savings Accounts

  • Inquire as to the balance in your Checking and Savings Accounts

  • Pay for purchases at places that have agreed to accept the Card

Some of these services may not be available at all terminals. 

Transfer Limitations - You may purchase goods or service through point of sale transactions and or obtain cash from an automated teller machine up to an aggregate maximum of $610.00 per day. Automated teller machine transactions are limited to $110.00, and point -of - sale transactions are limited to a maximum of $510.00 per day when the network is offline. The number of transfers from a savings account is limited as described in the applicable Membership and Account Agreement that was given to you at the time you opened your account.  If a hold has been placed on a deposit made to any account that you are permitted to transfer from, the funds will not be available to transfer until the hold expires.

 Fees and Charges - There is no charge for use of your NAFT Federal Credit Union ATM card at Automated Teller Machines owned and operated by NAFT Federal Credit Union and there are generally no fees associated with Point-of-Sale (POS) transactions.  However, NAFT Federal Credit Union charges a transaction fee for use of the card at non-proprietary Automated Teller Machines (ATM owned and operated by parties other than NAFT Federal Credit Union) in addition to any charge the owner of the machine imposes for the transaction(s). Please refer to your NAFT Federal Credit Union Rate and Fee Schedule for fees charged for ATM transactions.

 See Section 2 below for additional transfer limitations that apply to ATM Card transactions.

      VISA Check Card

Account Access - You may use your VISA Check Card and PIN to perform the same types of transactions as disclosed above for the ATM Card. Signature-based transactions do not require a PIN but may require positive identification.

 Some of these services may not be available at all terminals.

 Transfer Limitations - You may purchase goods or service through point of sale transactions and or obtain cash from an automated teller machine up to an aggregate maximum of $610.00 per day. Automated teller machine transactions are limited to $110.00, and point -of - sale transactions are limited to a maximum of $510.00 per day when the network is offline. Non-PIN (Signature) based transactions are limited to a maximum of $1,500.00 per day.  Non-PIN based transactions are limited to $510.00 when the network is offline.

Fees and Charges - There is no charge for use of your NAFT Federal Credit Union VISA Check Card at Automated Teller Machines owned and operated by NAFT Federal Credit Union.  However, NAFT Federal Credit Union charges a transaction fee for use of the card at non-proprietary Automated Teller Machines (ATM owned and operated by parties other than NAFT Federal Credit Union) in addition to any charge the owner of the machine imposes for the transaction(s). Please refer to your NAFT Federal Credit Union Rate and Fee Schedule for fees charged for VISA Check Card transactions.

      Audio Response System

      Account Access - You may use your Audio Response PIN to:     

  • Transfer funds between your Checking and Savings Accounts

  • Obtain your recent Account history and balance information

  • Make payments on your loan accounts with us by transferring from your NAFT Federal Credit Union Checking or Savings Account(s)

  • Please refer to our Audio Response brochure for a complete list of all available services

Transfer Limitations - See Section 2 below for transfer limitations that apply to Audio Response transactions.

 Home Banking Service

Account Access - You may use your Home Banking PIN to:

  • Transfer funds from your Savings and Checking Accounts

  • Obtain your recent Account history and balance information

  • Make payments on your loans with us from your Checking and Savings Accounts

Your contractual arrangement for the Bank365 Online Access agreement may provide for additional terms, conditions, disclosures, and limitations.

Transfer Limitations - See Section 2 below for transfer limitations that apply to Home Banking Service transactions.

 Direct Deposit and Preauthorized Withdrawal Transfers

You may make arrangements for certain direct deposits to be accepted into your Checking or Savings Accounts or to pay certain recurring bills from your Checking account(s). 

Transfer Limitations - See Section 2 below for transfer limitations that apply to Direct Deposit and Preauthorized Withdrawal transfers.

Other Withdrawal Transfers

If you pay for something by check and the merchant permits, you may authorize the merchant to convert your check to an electronic fund transfer. You may also authorize a merchant to electronically debit your Checking Account for returned check fees. You are deemed to have authorized these transfers if you sign an authorization or if you engage in the transaction after receiving notice that the transfer will be treated as an electronic fund transfer. 

2.   Transfer Limitations for Membership Share Accounts. Under government regulations that apply to your Membership Share, Special Club, Christmas Club, Sammy or Spirit Savings, and IRA Share Accounts, you may not make more than six transfers and withdrawals, or a combination of such transfers and withdrawals from these Accounts, per calendar month to another Account of yours at the Credit Union or to a third party by means of a pre-authorized or automatic transfer, or telephonic agreement, order, or instruction (including transfers by personal computer or other data transmission) and no more than three of the six transfers may be made by check, draft, debit card, or similar order made by you and payable to third parties. Withdrawals by mail, messenger, ATM, or in person, and transfers to make payments on your loans with us are not included in this limitation. But automatic or preauthorized transfers from your Accounts to make payments on loans that your family members may have with us are counted against this transaction limitation. If you exceed the number of transfers permitted, your Account may be closed. Preauthorized ACH debits or point of sale (Electronic) debits from your Membership Share, Personal Savings, Special Savings, Escrow Accounts, Christmas Club, IRA Share, Sammy or Spirit Savings accounts are prohibited by Credit Union Policy.

3. . Fees.  Please refer to our Fee Schedule accompanying this Agreement for disclosures of fees and charges that apply in connection with your use of electronic fund transfers services. In addition to the fees disclosed on our Fee Schedule, when you use an ATM not owned by us, you may be charged an additional fee by the ATM operator or any network used.  And you may be charged an additional fee for a balance inquiry even if you do not complete a fund transfer. 

4.   Business Days.  Our business days are Monday, Tuesday, Wednesday, and Thursday from 10:00 a.m. to 5:00 p.m., Friday from 10:00 a.m. to 6:00 p.m. and Saturday from 10:00 a.m. to 1:00 p.m., excluding holidays observed by the Credit Union and days, which due to circumstances beyond our control, we are unable to open and carry on substantially all business functions. 

5.  Documentation. 

(a) Terminal Transfers.  You can get a receipt at the time you make any transfer to or from your Account using an ATM or a point‑of‑sale terminal. 

(b)  Periodic Statements.  You will receive a monthly Account statement from us for your Checking and Savings Accounts if there is electronic fund transfer activity on the Account during a given month.  In any event, you will receive a statement for your Accounts at least quarterly. 

(c)  Direct Deposits.  If you have arranged to have direct deposits made to your Account at least once every 60 days from the same person or company, you can call us at (956) 787-2774 to find out whether or not the deposit has been made. If the only possible electronic fund transfers to or from your Account are preauthorized transfers, you will receive a statement for your Accounts quarterly. 

6.   Preauthorized Payments. 

(a)  Right to Stop Payment of Preauthorized Transfers and Procedure for Doing So. If you have arranged in advance to make regular payments from your Account, you can stop any of these payments. Here's how: 

Call us or write to us at the telephone number or address listed in these disclosures in time for us to receive your request three business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within 14 days after you call.  We will charge a fee as set forth in our Fee Schedule for each stop payment order you give.

 (b)  Notice of Varying Amounts.  If these regular payments may vary in amount, the person or company you are going to pay will tell you, ten days before each payment, when it will be made and how much it will be. You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment or when the amount would fall outside certain limits that you set.

(c)  Liability for Failure to Stop Payment of Preauthorized Transfer.  If you order us to stop one of these payments three business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages.

 7.      Contact in Event of Unauthorized Transfer.  If you believe your Card or PIN has been lost or stolen or that someone has transferred or may transfer money from your Account without your permission, call:

      You may report a lost or stolen ATM Card after hours by calling (956) 787-2774. You may report a lost or stolen VISA Check Card after hours by calling (800) 888-0085.  

8.   Confidentiality. We will disclose information to third parties about your Account or transfers you make:

 (a)  Where it is necessary for completing transfers, or

(b)  In order to verify the existence and condition of your Account for a third party, such as a credit bureau or merchant, or

(c)  In order to comply with government agency or court orders, or

(d)  If you give us your written permission. 

9.   Your Liability for Unauthorized Transfers and Advisability of Prompt Reporting.  Tell us AT ONCE if you believe your Card or PIN has been lost or stolen. Telephoning is the best way of keeping your possible losses down. You could lose all the money in your Account.   

(a) For Point-of-Sale Transactions with Your VISA Check Card. If you believe your Card or PIN has been lost or stolen, you will not be liable once you notify us that someone may or has used your Card or PIN without your permission. The foregoing liability limitation does not apply if you are grossly negligent or fraudulent in the handling of your Account or your Card. In those cases, your liability will be determined under the standards set forth below for all other transactions. 

(b)  For All Other Transactions. If you tell us within two business days, you can lose no more than $50 if someone used your Card or PIN without your permission. 

If you do NOT tell us within two business days after you learn of the loss or theft of your Card or PIN, and we can prove we could have stopped someone from using your Card or PIN without your permission if you had told us, you could lose as much as $500. 

Also, if your statement shows transfers that you did not make, tell us at once.  If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. 

If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods. 

  10.   Credit Union's Liability.  If we do not complete a transfer to or from your Account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions.  We will NOT be liable, for instance:

  • If, through no fault of ours, you do not have enough money in your Account to make the transfer.

  • If the terminal or system where you are making the transfer does not have enough cash.

  •  If the ATM or system was not working properly and you knew about the breakdown when you started the transfer.

  • If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.

  • If the funds in your Account are subject to an administrative hold, legal process, or other claim.

  • If the failure to properly complete the transaction is caused by erroneous information supplied by you or your agent.

  • If you have closed the Account from which you have preauthorized electronic fund transfers.

  • There may be other exceptions stated in our agreement with you.

 11.  In Case of Errors or Questions about Your Electronic Transfers. Call or write us at the telephone number or address listed in these disclosures as soon as you can if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt.  We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared.

  • Tell us your name and Account number.

  •  Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.

  • Tell us the dollar amount of the suspected error.

 If you tell us orally, we may require that you send us your complaint or question in writing within ten business days. 

We will determine whether an error occurred within ten business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will provisionally credit your Account within ten business days for the amount you think is in error, so that you will have use of the money during the time it takes us to complete our investigation. For VISA Check Card point-of-sale (non-ATM) transactions, we will provisionally credit your Account within five business days for the amount you think is in error unless we determine that the circumstances or your Account history warrants a delay of up to ten business days. If we ask you to put your complaint or question in writing and we do not receive it within ten business days, we may not credit your Account. 

For errors involving new Accounts, point-of-sale, or foreign-initiated transactions, we may take up to 90 days to investigate your complaint or question.  For new Accounts, we may take up to 20 business days to credit your Account for the amount you think is in error. 

We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation.  You may ask for copies of the documents that we used in our investigation.

12.   VISA Check Card Currency Conversion. If you effect a transaction with your VISA Check Card in a currency other than U.S. dollars, the rate of exchange between the transaction currency and the billing currency used for processing the international transaction will be: (i) a rate selected by VISA from the range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate VISA itself receives, or (ii) the government mandated rate in effect for the applicable central processing date; and in each instance, plus a 1% Foreign Transaction Fee. The Foreign Transaction fee will apply to all international purchase, cash advance, and Account credit transactions. 

 13.  Illegal Transactions. You agree that you will not cause or allow your Card or PIN to be used in any manner or for any transaction that we believe poses an undue risk of illegality, and we may refuse to authorize any such use or transaction. If you use your Card or PIN for a transaction that is determined to be illegal, you will be liable for the transaction. You also waive any right to take legal action against the Credit Union for your illegal use of your Card or PIN and agree to indemnify and hold harmless the Credit Union and VISA International, Inc. from and against any lawsuits, other legal action, or liability that results directly or indirectly from such illegal use. 

14.   ATM Safety Precautions. Exercise discretion when using an ATM or night deposit facility. Observe basic safety precautions. Prepare for any ATM transactions prior to approaching the ATM or night deposit facility. Retain your receipts, and do not leave them at the ATM or night deposit facility. Do not lend your Card to anyone, and do not leave your Card or any other documents at the ATM or any night deposit facility. Keep your PIN secret and memorize it. Do not give anyone information regarding your Card or PIN over the telephone. When using an ATM, place your body in a position so that you will prevent others from observing your PIN when entered. At any ATM or night deposit facility, keep a lookout for any suspicious activity near the facility and assure yourself that the facility and all approaches to the facility are well lighted. Conceal cash received from an ATM to the best of your ability and count it after you have left the ATM. If anyone offers assistance while you are operating an ATM, do not accept it. If you have begun a transaction, consider canceling the transaction and leaving the ATM location. Finally, compare your receipts against the statements you receive and notify us immediately if you suspect that an error or unauthorized transaction has occurred. 

Bill Payment Agreement & Disclosures

Welcome to Bank365 Bill Payment Service. Use of the Bill Payment Service indicates acceptance of terms and conditions set forth in this Bill Payment Agreement & Disclosures ("Agreement") as this may be amended from time to time. This Agreement is provided in electronic form, and by using the Bill Payment Service you agree to accept the Agreement in that form. Please read the Agreement carefully because it is our legal agreement with you that governs your use of our Bill Payment Service.

1. INTRODUCTION

Through Bank365, you may subscribe to our optional Bill Payment Service. The Bill Payment Service allows you to schedule payments through the Internet for current, future, and recurring bills from your checking account with us.

You may use our Bill Payment Service to direct us to make payments from your designated checking account to the Payees you choose in accordance with this Agreement. The terms and conditions of this Agreement are in addition to the agreements, disclosures and other documents in effect from time to time governing your deposit account with us, including the Deposit Account Agreement & Disclosures ("Deposit Agreement"), and the Bank365 Agreement & Disclosures.

"Bill Payment Service" and/or "Service" means the bill payment service that NAFT Federal Credit Union makes available over the Internet. "Credit Union", "bank", "we", "our", or "us" means NAFT Federal Credit Union. "Account" means the deposit account you designate to process Bill Payment transactions through. "Payee" or "Merchant" means anyone you designate and we accept as a payee. "Payment" means your remittance to a payee.

2. REQUIREMENTS & RESTRICTIONS

To subscribe to Bill Payment, you must designate a specific checking account to process your Bill Payment transactions through. The account you designate for this purpose must be in good standing with us in accordance with our criteria.

Requirements for dual signatures on checks do not apply to the Bill Payment Service.

3. PAYEE DESIGNATION

You can use the Bill Payment Service to make payments to almost any Payee or Merchant you want, including individuals, local service providers, utilities, credit cards, or to make mortgage or loan payments, or charitable donations, etc.

The Bill Payment Service cannot be used to make payments for the following:
 

  • Tax payments to the Internal Revenue Service or any state, local or other government agency;

  • Court-ordered payments such as child support or alimony; and

  • Payees located outside of the United States.

    By furnishing us with the names of your Payees (Merchants and/or individuals) and their addresses, you give us authorization to follow the Payment instructions, which you provide to us. When we receive a Payment instruction for the current date or a future date, we will remit the funds to the Payee on your behalf from the funds in your designated Account, on the day you have instructed them to be sent ("Payment Date"). We are not obligated to pay funds from your Account if the available Account balance is insufficient to cover the Payment. Funds for ALL bill payments, whether paid electronically or by check, will be withdrawn from your Account no later than three (3) business days following the Payment Date.

    We are not responsible if a Payment cannot be made due to incomplete, incorrect, or outdated information provided by you regarding a Merchant.

4. MAKING / SCHEDULING PAYMENTS

You may use the Bill Payment Service to authorize recurring payments or non-recurring payments. Recurring payments are payments that you schedule in advance to recur at substantially regular intervals in the same amount to the same Payee. Recurring Payments may be scheduled for up to ten (10) years.

Non-recurring Payments are a single, one-time Payment to a specified Payee. Non-recurring Payments may be scheduled to be initiated up to eighteen (18) months in advance.

Payments are processed Monday through Friday at 1PM Central Time, except on Federal holidays. If you attempt to schedule a Payment on a weekend or Federal holiday, you will be prompted to select a different date, or the Payment will be processed on the preceding business day if it is an auto recurring Payment. The Payment method may be electronic or by check. The first Payment to a Merchant must be scheduled at least five (5) business days prior to the due date for each Payment (recurring or variable) to allow adequate time for the Payment to reach the Payee. The due date is the date the Merchant has designated for payment, and should not be adjusted for any grace period or late date accommodations the Merchant may provide. Once the Service has been notified whether a Merchant accepts electronic payments or requires a paper check, after making the first Payment to that Merchant, the Service will display a message indicating that the Merchant requires either a two (2) day lead time for an electronic payment, or a five (5) day lead time if a paper check sent by regular mail is required.

Any Payments made with the Bill Payment Service require sufficient time for your Payee to credit your Account with them properly. To avoid incurring a finance charge or other charge, you must schedule a Payment sufficiently in advance of the due date of your Payment. If you fail to schedule your Payment according to the recommended timeframe, we will not be responsible for the late fees or finance charges. We will not be liable if any third party, through whom any Payment is made, fails to properly transmit the Payment to the intended Payee.

You agree to have available collected funds on deposit in the Account you designate in amounts sufficient to pay for all Payments requested, as well as any other payment obligations you have to us. We reserve the right to disable access to the bill pay service if you fail to comply with this requirement or any other terms of this Agreement. You further agree that we, at our option, may charge any of your accounts with us to cover such payment obligations.

        No single payment from NAFT Federal Credit Union Bill Payment Service can exceed $2,500.00.

 

5. CHANGE OR DELETE PAYMENTS / STOP PAYMENTS

Any Payment can be changed or cancelled; provided you access the Service prior to 1PM Central Time on the business day the Payment is going to be processed.

We shall not be liable to you due to a stop payment request if your order to do so is not presented prior to the time the check has cleared. Once the Payment has cleared, you can no longer stop payment.

6. PAYMENT GUARANTEE

If all Payment guidelines were followed and a Payment is still posted late to your Account with a merchant resulting in a late fee, at our discretion, we will make an attempt to have the Merchant waive the late fees. If the Merchant is unwilling to waive late fees, up to $50 in late fees assessed by the Merchant will be covered by us. However, due to factors beyond our control such as the U.S. Mail and payment processing at the Merchant, it is not guaranteed that a Payment will post on the fifth business day (or second, if issued electronically). It is imperative to note that Merchant grace periods are not taken into consideration, and if adequate lead time prior to the payment due date was not allowed by you in scheduling the Payment, this Guarantee is void.

NOTE: If the Merchant is not willing to discuss late fees or status of the account with us, you will be notified and advised that the Merchant requires your authorization before further discussions can occur between us and the Merchant.

7. LIABILITY

You are solely responsible for controlling the safekeeping of and access to your Bill Payment information. You are liable for all transactions you make, or that you authorize another person to make, even if that person exceeds his or her authority. If you want to terminate another person's authority, you must change your Bank365 logon password. In the event that you have experienced unauthorized access to our Bill Payment, you must notify us of the unauthorized access, identify any Payments made or potential Payments scheduled, and change your logon information.

You will be responsible for any Payment request you make that contains an error or is a duplicate of another Payment. We are not responsible for a Payment that is not made if you did not properly follow the instructions for making the Payment. We are not liable for any failure to make a Payment if you fail to promptly notify us after you learn that you have not received credit from a Payee for a Payment. We are not responsible for your acts or omissions or those of any other person, including, without limitation, any transmission or communications facility, and no such party shall be deemed to be our agent.

In any event, we will not be liable for any special, indirect, consequential, incidental, or punitive losses, damages, or expenses in connection with this Agreement or the Service, even if we have knowledge of the possibility of them. We are not liable for any act, failure to act or delay in acting if it is caused, in whole or in part, by any cause beyond our reasonable control.

8. INACTIVITY

If you do not access or use the Bill Payment Service for a period of more than ninety (90) days, we may in our sole discretion, terminate your access to and use of the Bill Payment Service without notice to you.

9. TERMINATION

We reserve the right to terminate your use of Bill Payment at any time without prior notice to you.

If, for any reason, you should want to terminate your use of our Bill Payment Service, we recommend that you cancel all future Payments and transfers at the same time you terminate the Service, either by deleting the Scheduled Payments yourself or by contacting the Credit union as stipulated below. We will delete all outstanding payments (both one-time and recurring), as part of your Service termination.

We are not responsible for any fixed Payment made before we have a reasonable opportunity to act on your termination notice. You remain obligated for any and all Payments made by us on your behalf through the Bill Payment Service.

Should you opt to discontinue any of the Accounts or Services to which this Agreement pertains, written notice must be provided to us immediately at the following address.

10. AGREEMENT ASSIGNMENT AND AMENDMENT

We may assign this Agreement to any affiliate, parent or other company. We may also assign or delegate certain of its rights and responsibilities under this Agreement to such third parties as we may elect upon notice to you whereupon we shall be released from any and all further liability or responsibility related thereto.

We reserve the right to amend or cancel any of the provisions of this Agreement, including changes to any fees, costs, or assessments. We may amend or cancel any provision or charge by disclosing the change electronically, and, at our option, by sending you notification in addition thereto. We will provide notice of thirty (30) days of any changes (or such lesser period as may be allowed by applicable law) unless an immediate change is necessary to maintain the security of the system. You may choose to accept or decline amendments, cancellations or changes by continuing or discontinuing the accounts or services to which these changes relate, at your option. We also reserve the option, in our business judgment, to waive, reduce or reverse charges or fees in individual situations.

11. MONTHLY SERVICE FEE

If you choose to enroll in NAFT Federal Credit Union's Bill Payment service you agree to pay a monthly service fee of $1.00 per month which will be deducted from your Share/Draft Checking account that is associated with your Bill Pay Service. The fee will be charged on the last day of each month beginning on the month following your enrollment date until the service has been terminated.

12.  SECURITY

You agree to protect the confidentiality of your account number, user name/identification and password at all times.  You also agree that you will not leave your computer unattended without signing off and closing all programs associated with NAFT Federal Credit Union's Bank365 and/or NAFT Federal Credit Union's Bill Payment service.
